Nailify Terms of Service
These Terms of Service ("Terms") govern your use of the Nailify iOS app ("Nailify," the "App"), provided by AZ Dezigns ("AZ Dezigns," "we," "us," or "our"). By downloading, accessing, or using Nailify, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Nailify. By using the App, you represent that you meet this requirement.
2. Your Account
Nailify uses "Sign in with Apple" to create your account. You are responsible for maintaining the security of the Apple ID used to sign in and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized use of your account.
3. The Service
Nailify lets you capture or select a photo of your hand or nails to receive an AI-generated nail health assessment and to preview AI-generated nail style try-ons. These features rely on third-party artificial intelligence services and are provided for informational and entertainment purposes only.
Nail Health Scan results are not medical advice. They are generated automatically and are not reviewed by a medical professional. Do not use Nailify as a substitute for professional medical, dermatological, or health advice, diagnosis, or treatment. Always consult a qualified healthcare provider with any questions about a medical condition.
Try-On results are AI-generated approximations. Generated images are simulations meant to help you visualize a style and may not precisely reflect how a style will look in real life.
4. Subscriptions and Payment
Nailify may offer auto-renewing subscriptions for premium features. All purchases are billed and processed by Apple through your App Store account, subject to Apple's own terms and payment methods. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your iOS device Settings under your Apple ID.
Prices are as displayed in the App at the time of purchase and may vary by region. Refunds are handled by Apple in accordance with Apple's refund policies; we do not process refunds directly.
5. Acceptable Use
You agree not to:
- Use Nailify for any unlawful purpose or in violation of these Terms;
- Upload photos that are not your own or that you do not have the right to submit;
- Upload photos of another person without their consent;
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to the App or its backend systems;
- Use the App to generate, upload, or distribute abusive, unlawful, or infringing content.
We may suspend or terminate your access if we reasonably believe you have violated these Terms.
6. User Content
You retain ownership of the photos you submit. By submitting a photo, you grant AZ Dezigns and its service providers (including OpenAI, for processing, and Supabase, for storage) a limited license to process, store, and display that photo and any AI-generated output solely to provide the App's features to you. 7. Intellectual Property
Nailify, including its design, branding, and underlying software, is owned by AZ Dezigns and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Disclaimers
NAILIFY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI-GENERATED RESULTS MAY BE INACCURATE, INCOMPLETE, OR UNSUITABLE FOR YOUR PURPOSE. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZ DEZIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF NAILIFY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Termination
You may stop using Nailify and delete your account at any time from within the App. We may suspend or terminate your access to the App at our discretion, including for violation of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date above when we do. Continued use of Nailify after a change means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law principles, except where applicable law requires otherwise.
